4. The following categories of persons or legal entities are not eligible to participate in the Lucky Draw and Promotion Program (“Non-Eligible Participants”):

• any employees of ATOM, including employees on full-time, part-time, permanent, or temporary arrangements.
• any service providers to ATOM or business partners of ATOM, as well as employees of such; or
• any parties involved in sale or distribution of any ATOM products or services, as well as employees of such.

ATOM shall have the absolute discretion to determine the eligibility of any Participants, including after a Participant has won a prize. Any prizes won by a Non-Eligible Participant shall be retained by ATOM and disposed of at ATOM`s sole discretion.

5. ATOM Customers are eligible to participate in Lucky Draw and Promotion Program based on purchase of ATOM’s limited packages (“Eligible Customer”) through ATOM Store App. The eligible customers who can access ATOM store application will be offered one free lucky chance as daily basic.

6. All Eligible Customers will be offered Game Chances based on the successful ATOM package purchased during the Lucky Draw and Promotion Period(“Game Lucky Chances”). If the eligible customers buy more expensive packages, they can earn more game lucky chances.

7. After purchasing of any limited packages from ATOM, eligible customers will need to access their “ATOM Store” app and claim the available lucky chance within 48 hours from the purchase of the package. If lucky chances are not claimed within 48 hours, the Eligible Customers will not receive any lucky chances from their purchase of the packages. Customers will not be compensated or refunded for any expired game lucky chances.

8. The eligible customers can also buy one lucky chance with ninety-nine Kyats (MMK 99/-) (“Paid chance”) from their main balance. Paid chance shall be deducted from the main balance of the eligible customer. Eligible Customers will need to access their “ATOM Store” app and use the paid chance (before the campaign ends). If the paid chances are not claimed (till last day of campaign), the Eligible Customers will not be able to participate in the game program or to win any prizes. Customers will not be compensated for any expired Paid chances. ATOM shall be entitled to change the number of free game chances and the fees of paid chance before the end of lucky draw period.

9. Game Lucky Chances that are claimed in accordance with section 7 of these T&C will be valid until the end of the Campaign. No compensation will be offered for game lucky chance that expires. Each game lucky chance right to do one chance to play the Toh Toh Topia Game and get the instant prizes (“Lucky Chance to play the game”) in the “ATOM Store” app.

10. Eligible Customers will have to follow the Lucky Draw Game Rules to play the Toh Toh Topia Game since they have participated in this Lucky Draw (“Game Player”). Details of Lucky Draw Game rules are as follows:

• In game level 1 (Htoke See Toe game) : The game player shall move the Toh Toh (left or right) and avoid the other players' catching the Toh Toh and go through until the end point.
• In game level 2 (Bar Sar game) : The game player shall choose the correct ingredients recipes to make the foods what Toh Toh is thinking to eat after playing the level 1, Htoke See Toe game.
• In game level 3 (Sein Pyay Lite Tan game) : The game player (Toh Toh) shall catch to his 3 friends in Sein pyay lite tan game within limited timeframe.
• Whether the Customer fail the game level, they need to use 1 lucky chance to play the game from the beginning (or) they can buy in-game Booster feature with 49 Kyats from their main balance to continue the current game from the fail place only.

11.The Eligible customer can have the instant rewards if they win each game level. The list of Instant Rewards are as follows:

• Cash back
• Free Internet Data (MB)
• Free On-net Call
• Free On-net SMS

12. The winners of Cashback, Free Internet Data Winner, Free On-net Call, Free On-net SMS (“Telco Prizes”) will obtain these prizes as a direct credit to their internet and SMS balance as soon as practicable after winning the Lucky Draw game. The Free On-net Calls and Free SMS can only be connected between ATOM users. The Telco Prizes will have 3 days validity.

13. Lucky Draw for Instant Prizes are subject to a limited number of prizes per day – as discretionary set by ATOM. ATOM will not have any liability or responsibility towards customers playing the game after the daily allocation of Instant Prizes are given away. Instant prizes will be expired within 3 days after the game players receiving such prizes.

14. Promotion Program: Customers who play Toh Toh Topia game must be complected Level (3). Whoever complete the Toh Toh Topia game level (3), they have (1) lucky draw tickets to win the weekly cash prizes. However, users will not see their available lucky draw tickets in game Uls. ATOM selects the random computerize draw on weekly basis based on lucky draw tickets. The winning prize is cash (20) prizes for level (3) complected users. ATOM shall announce winners of the promotion once a week before event complete (“Weekly Promotion Prize Winner”). Customers would not be compensated for any expired game lucky draw tickets.

15. All relevant tax, costs, charges, fees and/or expenses of whatsoever nature that is associated with the Prize shall be sole responsibility of the winner.

16. ATOM will not have any responsible for warranty, condition for the winning prizes.

17. ATOM is not liable for the loss, damages, validity of stock for prizes and prizes that are undelivered due to incorrect or changed address or other contact information.

18. ATOM will try to contact each of the Weekly Promotion Prize winners three times within live draw period after drawing is made, in a way that ATOM deems fit. Prizes assigned to any winner who ATOM is not able to reach within period pre-determined by ATOM, or prizes assigned to winners who fail to comply with any instructions specified by ATOM, shall be forfeited by the Winner and shall be retained by ATOM and disposed of at ATOM`s sole discretion. The cash prizes transfer shall be taken estimate (8) working days after coming out the winners list from the live draw. The Cash Prize shall be paid to customer at only the designated bank of ATOM. Customers need to provide the required personal information to transfer cash.

19. ATOM reserves the right to refuse to provide any prizes to winners that are not legally permitted to own or operate such prizes. In the event of any such refusal as outlined in this section, ATOM shall have the full discretion to withdraw the prize and make use of such prizes as ATOM deems fit. The winner shall agree the way/process to receive the prizes that proposed by ATOM. ATOM also reserves the right of refusing to provide the prizes to the winner who disagree the convenience way/process to receive the prizes that proposed by ATOM.

20. In connection with the collection of prizes, ATOM will conduct customer validation process such as verifying customer’s name, last balance top-up amount, most call/frequent numbers, and personal information. ATOM reserves the right to refuse to provide prizes to parties that do not pass the customer validation process.

21. ATOM also assumes no responsibility for any loss or damage or expenses arising in connection with the Lucky Draw, howsoever arising, including without limitation, from any late or non-notification, any error in computing, technical hardware or software breakdown, malfunctions or defects, failed, delayed or incorrect transactions, or lost or unavailable network connections, or any notice that is lost or misdirected and any situation which is beyond the control of ATOM which may affect any customer’s eligibility for the Lucky Draw.

22. Unless otherwise covered in these T&C, prizes will either be delivered to the winners by ATOM, or will have to be collected, by winners at ATOM’s main office at Sule Square, 221 Sule Pagoda Road, Yangon, Myanmar. ATOM shall have the full discretion to decide if prizes shall be delivered to the Customer or collected at ATOM`s main office or other offices. ATOM will not take any responsibility when the prizes are impossible to deliver for the condition of beyond ATOM’s reasonable control or impossible to collect by the winner. ATOM shall be entitled to reuse these prizes for other winners or other campaigns with their own discretion.

23. ATOM reserves the right to hold void, cancel, suspend, or amend the Terms and Conditions of this Lucky Draw where it becomes necessary to do so at its full discretion.

24. Nobody shall transfer the tickets and/or prizes with money value. The prize for the winner is non-exchangeable, non-transferable and no cash alternative is offered by ATOM (or) Partner. Unless otherwise stated in these T&C, a winner who is awarded a prize might however at its discretion sell or dispose of one or more prizes as the customer deems fit. Where prizes contain a specific date during which the prize should be accepted or utilized, no requests for extensions or replacements whatsoever will be entertained. ATOM does not accept and expressly disclaims any warranties express or implied in connection with any prizes to the fullest extent permitted by applicable law. Participants are deemed to have accepted and agreed to be bound by these Terms & Conditions. If tax and other payment are payable with respect to a won prize, such tax is the sole responsibility of the winner.

25. By participating in ATOM’s Lucky Draw, customers agree and permit ATOM, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and without limitation, the customers’ name, picture, image and statements about ATOM’s Lucky Draw and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent to the furthest extent possible under law.

26. ATOM reserves the right to replace the prize with an alternative prize if the circumstances beyond ATOM’s control make it necessary to do so.

27. The decision of ATOM regarding any aspect of the Lucky Draw is final and binding.

28. ATOM reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions and the person who cannot provide or refuse to provide the required information/ document or provide incomplete information/ document as ATOM’s think fit and necessary to deliver the prizes.

29. Winners of a Lucky Draw shall sign all required documents and provide any information for formalities and/or regulatory processes as deemed to be required or appropriate by ATOM.

30. The Lucky Draw and these Terms and Conditions shall be governed by the laws of the Republic of Union of Myanmar and all Participants (including the Winners) are deemed to have agreed to submit to the exclusive jurisdiction of the Myanmar Courts.

31. In the event of inconsistencies or discrepancy between the English and Myanmar version of these Terms and Conditions, the English version shall prevail.
